Important Notices

1. NO MEDICAL ADVICE

THE PLATFORM IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

NammaDoctor is a healthcare appointment booking and queue management platform. We provide tools to:

  • Search for healthcare providers
  • Book appointments
  • Track queue positions
  • Manage provider schedules

We do not provide medical advice, diagnosis, or treatment recommendations.

Always seek the advice of qualified healthcare professionals for any medical questions, symptoms, or conditions. Never disregard professional medical advice or delay seeking it because of information obtained through this Platform.

2. NOT FOR EMERGENCIES

THE PLATFORM IS NOT DESIGNED FOR MEDICAL EMERGENCIES.

If you have a medical emergency:

  • **Immediately call your local emergency services number (108 in India)**
  • **Go to the nearest emergency facility**
  • **Do not use this Platform for emergency medical situations**

Examples of medical emergencies include but are not limited to:

  • Chest pain or difficulty breathing
  • Severe bleeding or trauma
  • Loss of consciousness
  • Severe allergic reactions
  • Suspected stroke or heart attack
  • Any life-threatening condition

3. "AS IS" SERVICE

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties regarding accuracy, reliability, or availability
  • Warranties that the Platform will be uninterrupted, secure, or error-free

We make no guarantees about:

  • The availability or reliability of healthcare providers listed
  • Appointment confirmations or queue positions
  • Accuracy of wait times or provider information
  • Continuous operation of the Platform

4. Third-Party Services

We rely on third-party services including:

  • Payment processors (PhonePe, Zoho Pay, etc.)
  • Communication providers (email, SMS, WhatsApp)
  • Infrastructure providers (hosting, database services)
  • Mapping and location services

We are not responsible for failures, errors, or disruptions in these third-party services.

5. Healthcare Provider Responsibility

Healthcare providers listed on the Platform are independent professionals or organizations. We do not:

  • Employ or directly supervise healthcare providers
  • Control the quality of care provided
  • Make recommendations about specific providers
  • Guarantee provider credentials or qualifications
  • Bear responsibility for medical outcomes

Patients are responsible for:

  • Verifying provider credentials
  • Evaluating quality of care
  • Making informed healthcare decisions
  • Following up on appointments
  • Maintaining their own medical records

6. Information Accuracy

While we strive to provide accurate information, we do not guarantee:

  • The completeness or accuracy of provider listings
  • Real-time accuracy of queue positions or wait times
  • Availability of specific time slots or services
  • Currency of provider information (credentials, specialties, etc.)

All information on the Platform is for informational purposes only.

Users should independently verify:

  • Provider credentials and qualifications
  • Clinic addresses and operating hours
  • Service availability and pricing
  • Insurance acceptance

7. No Absolute Security

While we employ reasonable technical and organizational safeguards to protect user data, no system is invulnerable.

We cannot guarantee:

  • Absolute security of user data
  • Prevention of all unauthorized access
  • Perpetual data retention
  • Complete protection against cyber threats

Users accept inherent risks associated with:

  • Internet transmission
  • Electronic storage
  • Online transactions
  • Data processing

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

NavinaX shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Cost of substitute services
  • Personal injury or emotional distress (except where prohibited by law)
  • Any damages arising from healthcare provider actions, medical outcomes, or quality of care

Our total aggregate liability for all claims arising out of or related to the Platform shall not exceed the greater of:

  • ₹5,000 (Indian Rupees Five Thousand); OR
  • The total fees actually paid by you to NavinaX in the three (3) months immediately preceding the event giving rise to the first such claim

This limitation applies to any damages whatsoever arising from:

  • Use or inability to use the Platform
  • Unauthorized access to your data
  • Errors, bugs, or interruptions in service
  • Acts or omissions of any third party, including healthcare providers
  • Any other matter relating to the Platform

These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Exceptions: Nothing in this Disclaimer excludes or limits liability for:

  • Gross negligence or willful misconduct
  • Fraud or fraudulent misrepresentation
  • Death or personal injury caused by negligence (where such exclusion is prohibited by law)
  • Any liability that cannot lawfully be excluded or limited under applicable Indian law

9. Jurisdictional Limitations

Some jurisdictions do not allow certain disclaimers or limitations of liability. In such jurisdictions, the above limitations apply only to the extent permitted by law.

If you are located in a jurisdiction that restricts liability disclaimers, the limitations that apply to you are the maximum permitted under applicable law.

10. User Responsibility

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring the accuracy of information you provide
  • Complying with all applicable laws and regulations
  • Making informed decisions about your healthcare
  • Verifying information before relying on it
  • Understanding these limitations before using the Platform

We reserve the right to modify this Disclaimer at any time. Changes will be effective immediately upon posting to the Platform.

Your continued use of the Platform after changes constitutes acceptance of the updated Disclaimer.
